General Conditions of Sale

Article 1: Scope of Application

These General Conditions of Sale apply to all digital transactions concluded through Systeme.io on behalf of Eksakt Positioning and Messaging Strategy (“the Company”).
Any natural or legal person placing an order through our Systeme.io sales pages and making payment via Stripe is considered a “Client.”
By confirming an order, the Client acknowledges that they have read, understood, and unreservedly accepted these General Conditions of Sale.

Article 2: Eligibility and Age Requirements

The Company offers its digital courses, workshops, and programs exclusively to Clients aged 18 years or older.
By purchasing any product or service, the Client confirms that they meet this minimum age requirement.
If the Company becomes aware that a Client does not meet this requirement, the purchase will be cancelled and refunded.

Article 3: Orders

All orders are placed through the Systeme.io platform.
By validating an order, the Client confirms their full and unreserved acceptance of these General Conditions of Sale, including any referenced policies such as the Privacy Policy.

The Client is responsible for ensuring that all information provided during the ordering process is accurate and up to date. The Company cannot be held liable for delivery failures or communication errors caused by incorrect information.

Article 4: Prices

All prices are indicated in euros (EUR) and include all applicable taxes, unless otherwise stated.
Prices may change at any time; however, the price applied to an order is that shown at the time of purchase.

Article 5: Payment Terms

Payment is due in full at the time of order placement.
Payments are securely processed through Stripe, the third-party payment processor integrated within Systeme.io.
Accepted payment methods are international credit or debit cards (Visa, Mastercard, etc.).
The Company does not store any credit card details and is not responsible for any technical or security failures attributable to Stripe or Systeme.io.
Access to the digital product or service will be granted only once payment has been successfully received.

Article 6: Delivery of Digital Products

Upon confirmation of payment, Clients will receive access to the purchased digital product, course, or service via Systeme.io and/or by email at the address provided at checkout.
The delivery is considered complete once digital access has been made available to the Client.
The Client is responsible for maintaining access to their Systeme.io account and for ensuring that their email system allows the delivery of transactional messages.

Article 7: Right of Withdrawal and Refund Policy

As required by EU consumer protection law, Clients residing within the European Union have a 14-day right of withdrawal for digital content purchases, unless they expressly consent to the immediate delivery of the product and thereby waive their withdrawal right.

At checkout, Clients may be asked to confirm that they agree to immediate access to digital content and understand that this voids the statutory withdrawal right.

If no such waiver is provided, Clients may exercise their right of withdrawal by sending a written request to [insert contact email] within 14 days of purchase.
Refunds will be processed within a reasonable period, using the same method as the original payment.

For Clients outside the EU, refund rights will be handled in accordance with applicable local consumer protection laws.

Article 8: Data Protection and Privacy

The Company complies with the General Data Protection Regulation (GDPR) (EU) 2016/679 and all applicable data protection laws.
Personal data collected during the order process (such as name, email, and payment information) are processed solely for the purpose of fulfilling the order, managing access to digital products, and maintaining client communications.

The Company does not share or sell Client data to third parties except as required by law or to service providers (such as Systeme.io and Stripe) acting as data processors under strict confidentiality obligations.

Article 9: Intellectual Property

All materials, frameworks, videos, audio files, documents, and content provided through the Company’s digital products are protected by intellectual property law.
Clients receive a personal, non-transferable license to use the purchased materials for their own professional or personal development.
Reproduction, distribution, modification, or resale of any material, in whole or in part, is strictly prohibited without prior written consent from the Company.

Article 10: Limitation of Liability

The Company provides digital educational content and services for informational and developmental purposes only.
While every effort is made to ensure quality and accuracy, the Company cannot guarantee specific results or outcomes.
Under no circumstances shall the Company be held liable for any indirect, consequential, or financial losses resulting from the use or misuse of its products or services.

Article 11: Force Majeure

The Company shall not be held responsible for delays or failure to perform obligations due to events beyond its reasonable control, including but not limited to natural disasters, technical failures, strikes, or acts of government.

Article 12: Governing Law and Jurisdiction

These General Conditions of Sale are governed by and construed in accordance with Danish law.
In case of dispute, the parties shall first seek an amicable solution.
Failing that, any dispute shall be submitted to the courts of Copenhagen, Denmark, which shall have exclusive jurisdiction.
